Using this site
HeartCode is a no-signup website builder. You do not need to create an account or register with HeartCode to create a website.
You choose a website type, provide the information requested by the selected template, generate and review a preview, complete payment, and deploy the website.
By using HeartCode, you agree to these Terms and Conditions. If you do not agree with these terms, do not use the site or purchase a website through it.
Creating a website
You are responsible for the information and content you provide while creating a website.
You must have the right to use any text, images, music links, names, or other content that you submit for inclusion in your website.
You must not use HeartCode to create content that is unlawful, fraudulent, abusive, threatening, defamatory, invasive of another person's privacy, or intended to facilitate illegal activity.
You must not use HeartCode to create a website that impersonates another person or organization for the purpose of deceiving visitors.
Your content
You retain responsibility for the content you submit and choose to include in your website.
HeartCode does not claim ownership of the personal messages, memories, names, images, or other original content that you provide for your website.
By submitting content for the purpose of creating a website, you give HeartCode permission to process that content as necessary to generate, preview, deploy, maintain, and provide the website you requested.
You are responsible for making sure that the content you submit does not violate another person's rights or any applicable law.
Information about other people
You may create a website for another person, including a friend, partner, family member, or relative.
If you provide another person's information, you are responsible for making sure that you have permission or another lawful basis to use that information in the website you create.
Do not submit sensitive personal information that is not necessary for the website.
Previewing your website
HeartCode allows you to preview your website before purchasing deployment.
The preview is provided so that you can review the content and appearance of the website before completing your purchase.
You are responsible for reviewing your website before payment and deployment and for making sure that the information displayed is correct.
Pricing
Pricing may vary depending on the website type you choose.
The applicable price is displayed to you during the purchase process. The price shown at checkout is the price you pay for that website unless a correction is required because of an obvious pricing or technical error.
HeartCode may change its prices for future purchases. A price change does not change the price of a purchase that has already been successfully completed.
Payment
Payment for HeartCode websites is processed by Paystack.
HeartCode does not process or store your payment card details directly.
By completing payment, you also agree to any applicable Paystack terms governing the payment transaction.
A website is deployed after HeartCode receives confirmation that the required payment has been successfully completed.
Successful payment
A successful payment authorizes HeartCode to provide the website deployment associated with that purchase.
If payment is completed but a technical problem prevents deployment, HeartCode will take reasonable steps to resolve the problem or provide an appropriate remedy.
One-time payment
HeartCode website purchases are one-time payments unless a specific product clearly states otherwise.
Purchasing a HeartCode website does not automatically create a recurring subscription or recurring payment.
Website deployment
After successful payment, HeartCode deploys the website you created using the information and options you selected during the build process.
The deployed website may contain the names, messages, dates, images, links, and other information that you chose to include during creation.
You are responsible for checking your website before deployment and for the information you choose to publish through it.
Your deployed website
The website created through HeartCode is created for you based on the information and options you provide.
You may share the deployed website with other people and decide how you want to use it, subject to these terms and applicable law.
HeartCode provides the service used to create and deploy the website but does not take responsibility for the personal or other content you choose to publish through it.
Website availability
A successfully deployed HeartCode website is intended to remain available after purchase without requiring a recurring subscription.
HeartCode does not guarantee uninterrupted availability of every deployed website at all times. Websites may occasionally become unavailable because of maintenance, technical failures, hosting issues, security incidents, infrastructure changes, or circumstances outside HeartCode's reasonable control.
Site passwords
Every HeartCode website supports password protection.
When deploying your website, you can choose whether to password protect it or leave it publicly accessible.
If you choose password protection, visitors must enter the password you selected before they can access the protected website.
Your site password is not stored by HeartCode in a form that allows it to be recovered or displayed to you later.
If you forget your site password, HeartCode cannot look up the original password for you.
HeartCode retains the website address associated with your purchase so that relevant website details can be provided through the available recovery process. The website address is not the same as your site password.
Password protection is intended to control access to your deployed website. You are responsible for keeping your password private and for deciding who receives it.
Public websites
If you choose not to password protect your website, the website may be accessible to anyone who has its web address.
You should not publish information on a public website that you do not want other people to see.
AI-generated content
Some HeartCode website types may offer optional AI assistance.
Where AI-generated content is used, the generated content is based on information submitted through the relevant build form and the instructions provided to the AI feature.
AI-generated content may contain mistakes, inaccuracies, inappropriate wording, or information that does not accurately reflect what you intended.
HeartCode does not guarantee the accuracy, completeness, suitability, originality, or reliability of AI-generated content.
You are responsible for reviewing AI-generated content before using it in your deployed website.
AI assistance is optional and is not required to create a HeartCode website.
Third-party services
HeartCode uses third-party services where necessary to operate parts of the service.
These services may include payment processing, email delivery, hosting, infrastructure, security, abuse prevention, and optional AI functionality.
Third-party services may have their own terms and policies. Your use of those services may be subject to their applicable terms.
Website links and third-party content
A HeartCode website may contain links to third-party websites or services, including links that you choose to add during the website-building process.
HeartCode does not control the content, availability, security, or privacy practices of third-party websites.
You are responsible for the third-party links and content that you choose to include in your website.
Prohibited use
You must not use HeartCode to:
- Create or distribute unlawful content.
- Attempt to defraud or deceive another person.
- Impersonate another person or organization for a deceptive purpose.
- Publish another person's private information without appropriate authorization.
- Distribute malware, malicious code, or harmful software.
- Attempt to interfere with or disrupt HeartCode or its infrastructure.
- Attempt to bypass access controls or password protection.
- Attempt to gain unauthorized access to another person's website or information.
- Use automated requests in a way that places unreasonable load on the service.
- Use HeartCode for activity that violates applicable law.
Abuse and service restrictions
HeartCode may restrict, suspend, or remove access to a website or service where it is reasonably necessary to prevent abuse, address a security problem, comply with a legal requirement, respond to unlawful content, or protect the service and its users.
Where reasonably possible, HeartCode may contact the relevant customer before taking action. This may not be possible where immediate action is necessary for security, legal, or abuse-prevention reasons.
Website removal
HeartCode may remove or disable a deployed website if its content violates these terms, violates applicable law, creates a security risk, or is being used to abuse the service.
If you believe that a website created through HeartCode should be removed because it infringes your rights or contains unlawful content, contact HeartCode with sufficient information for the issue to be reviewed.
Site recovery
HeartCode provides a recovery process for customers who lose their website details.
The recovery process may require the email address used during checkout so that HeartCode can identify the relevant purchase and send the corresponding website information.
HeartCode does not provide a forgotten site password through the recovery process because site passwords are not stored in a recoverable form.
Refunds
Refunds are handled according to HeartCode's refund policy.
If a technical problem prevents HeartCode from providing the website that you successfully purchased, contact HeartCode so that the issue can be investigated and an appropriate solution can be provided.
Because a website may be generated and deployed specifically from the information you submit, you should review the preview carefully before completing payment.
Intellectual property
The HeartCode service, including its software, interface, original template designs, branding, logos, graphics, and other original materials provided by HeartCode, remains the property of HeartCode or its respective rights holders.
You may use the website you purchase for its intended personal or other lawful purpose, subject to these terms.
You must not copy, reproduce, resell, redistribute, or commercially exploit HeartCode's underlying software, templates, source code, branding, or other protected materials unless you have permission to do so.
HeartCode branding
Where a deployed website contains HeartCode branding or attribution, that branding may not be removed or altered unless the applicable HeartCode product or plan expressly permits you to do so.
Accuracy of information
You are responsible for reviewing the information you provide before deploying your website.
HeartCode is not responsible for spelling mistakes, incorrect dates, incorrect names, incorrect links, inaccurate personal information, or other errors caused by information supplied by you.
Technical errors
HeartCode may correct obvious technical or pricing errors on the website.
If a technical error affects a purchase or prevents the service from operating as intended, HeartCode will make reasonable efforts to resolve the issue.
Service changes
HeartCode may add, modify, improve, suspend, or discontinue features of the service.
Changes may include changes to website templates, available customization options, deployment systems, supported integrations, pricing, or other parts of the service.
HeartCode will not intentionally remove access to a successfully purchased website solely to force you into a subscription.
Availability of third-party services
Some HeartCode functionality depends on third-party services and infrastructure.
HeartCode cannot guarantee the continued availability of a third-party service that it does not control.
Limitation of responsibility
HeartCode provides its website-building service on an as-available basis and does not guarantee that the service will operate without interruption or errors.
To the extent permitted by applicable law, HeartCode is not responsible for losses caused by information that you voluntarily publish, third-party websites that you link to, incorrect information you provide, misuse of your website, or circumstances outside HeartCode's reasonable control.
Your responsibility for your website
You are responsible for the content, information, links, access decisions, and use of the website you create.
You are also responsible for deciding whether your website should be publicly accessible or password protected and for keeping your website password private if you choose to use one.
Privacy
Information about how HeartCode processes information is explained in the HeartCode Privacy Policy.
By using HeartCode, you acknowledge that you have had the opportunity to review the Privacy Policy.
Changes to these terms
HeartCode may update these Terms and Conditions when the service, its features, or its legal requirements change.
The latest version will be published on this page. Your continued use of HeartCode after an updated version has been published means that you accept the updated terms to the extent permitted by applicable law.
